This includes the decedent during his or her lifetime making transfers, gifts, a new Will or a new Trust or amendments thereto while incompetent or under the undue influence, duress or coercion of another.
Also, an executor or trustee can violate the rights of a beneficiary by self-dealing, commingling estate or trust assets and personal assets, failing to account for estate or trust assets, failing to properly preserve the assets and make them productive, failing to remain impartial in the treatment of the beneficiaries, and failing to allocate or distribute the assets in accordance with the terms of the Will or Trust.
